Terms and Conditions of Use

Introduction

These 'Terms and Conditions of Use' (T&C) aim to legally frame the terms of use of the mobile application (hereinafter referred to as 'Pass Jeunes') by the user (hereinafter referred to as the 'User' or 'Youth Beneficiary').

These Terms and Conditions of Use must be accepted by any User wishing to access the Pass Jeunes offers. They constitute the contract between Pass Jeunes and the User.

The User must commit to carefully reading the contents of this document, which includes the General Terms and Conditions of Use, and expressly and unreservedly accept all the rules and obligations contained therein.

Access to Pass Jeunes by the User signifies their acceptance of these T&C.

In the event of non-acceptance of the general terms and conditions of use stipulated in this contract, the User must refrain from accessing the offers proposed by Pass Jeunes.

Access to Pass Jeunes Offers

Pass Jeunes allows the user free access to the following services:

● Benefit from offers listed by the ministry on the mobile application;

● Follow news and cultural events (on Pass Jeunes, by email, or notification).

Pass Jeunes is freely accessible anywhere to any User with an internet connection. All costs incurred by the User to access the service (hardware, software, internet connection, etc.) are at their expense.

Pass Jeunes implements all means at its disposal to ensure quality access to its services. The obligation is one of means, and Pass Jeunes does not commit to achieving this result.

Any event due to a case of force majeure resulting in a malfunction of the network or server does not engage the responsibility of the ministry.

Access to Pass Jeunes services may be interrupted, suspended, or modified at any time without notice for maintenance or any other reason. The User agrees not to claim any compensation following the interruption, suspension, or modification of this contract.

Use of Cookies and Trackers

The Application uses the services of Google Analytics, the terms of use of which are available here: https://marketingplatform.google.com/about/analytics/terms/fr/.

Intellectual Property

The trademarks, logos, signs, and all other content of the Pass Jeunes application are protected by the Intellectual Property Code and more particularly by copyright.

The User requests prior permission from Pass Jeunes for any reproduction, publication, or copying of the various contents.

The User undertakes to:

• Use the content of Pass Jeunes strictly for private purposes. Commercial use of the content is strictly prohibited.

Any content uploaded by the User is their sole responsibility.

• Not to upload content that could harm the interests of third parties.

• Create only one personal account corresponding to their identity.

• Remain solely responsible for any use that may be made of their identifiers and password, as well as for the confidentiality of their account and any use of their personal account.

• Immediately inform of any use or risk of fraudulent use of their personal account, and any breach of the confidentiality and security of their identifiers and password, at the email address provided.

Without limiting this list, the User is expressly prohibited from:

• Undertaking unauthorized or fraudulent use of the Application and/or its content for illicit purposes or effects.

• Accessing or attempting to access restricted resources or areas of the Application without meeting the required conditions for access.

• Introducing or disseminating computer viruses or any other physical or logical systems that could cause damage to the physical or logical systems of the Application, other Users, or any third parties.

• Submitting content that could constitute an offense known as 'press offenses,' as per Law No. 88-13 concerning the press and publishing, promulgated by Decree No. 1-16-122 of 6 Kaada 1437 (10 August 2016).

• Disseminating any data, information, or content that is defamatory, abusive, obscene, racist or xenophobic, offensive, incites hatred or violence, is threatening, constitutes harassment, or is generally contrary to applicable laws and regulations, good morals, or public order.

Any legal action taken against the site by an aggrieved third party will be borne by the User.

The interpretation and validity of these T&C and everything arising from them are subject to Moroccan law and regulations in force, to the exclusion of any other legislation, regardless of the nationality of the User. This applies to both substantive and procedural rules. In the absence of an amicable agreement between the parties and in the event of failed negotiations, the parties will regain their full freedom, and their dispute will be brought before the Moroccan courts of the Kingdom.

The content of the User may be deleted or modified by the Pass Jeunes application at any time and for any reason. The User will not receive any prior justification or notification before the deletion or modification of User content.

The T&C may also be modified at any time without notice. Users will be informed of the modification of these T&C by the publication of the updated T&C on the application and by a notification indicating this change within the application. In this regard, the modified T&C will take effect from their publication. The continued use of the application following this publication will constitute acceptance of the new version of the T&C.

Personal Data

By checking a box in the data collection form (registration form), which refers to the T&C including a clause on the protection of personal data, the User consents to the computer processing of all data provided in the form. This data may be used for communication purposes as part of processing the file and will not be used for direct or indirect marketing activities.

The ministry undertakes to process the data communicated to it in accordance with Law No. 09-08 concerning the protection of individuals with regard to the processing of personal data, promulgated by Decree No. 1-09-15 of 22 Safar 1430 (18 February 2009) and which established a national commission for the control of the protection of personal data, responsible for implementing and ensuring compliance with the provisions of this law and the texts issued for its application.

We request and collect the following personal information about you when you use the Pass Jeunes service. This information is necessary for the proper execution of this service and to allow us to meet our legal obligations. Without this information, we may not be able to provide you with all the requested services.

● Account information: When requesting a Pass Jeunes on the application, we ask you to provide us with certain information such as your first name, last name, age, phone number, email address, city, and national ID number (N° CIN), as well as a selfie/photo of the User and a scanned/photo copy of the ID card.

● Information that we collect automatically when you benefit from a Pass Jeunes offer.

When you use the Pass Jeunes service, we automatically collect information, including personal information. This information is necessary for the proper execution of the agreement between you and us, for us to comply with legal obligations, and in view of our legitimate interest in being able to provide the offers proposed by our partners.

1. Use of the Information We Collect

The information collected on the application is subject to processing intended to grant offers to youths aged 16 to 30 (freebies, discounts, etc.) granted either by the Ministry of Youth, Culture, and Communication or by its partners.

In accordance with Law No. 09-08 promulgated by Decree No. 1-09-15 of



18 February 2009 concerning the protection of individuals with regard to the processing of personal data, you have the right to access and rectify information concerning you, which you can exercise by contacting [email protected]. You may also, for legitimate reasons, object to the processing of data concerning you. This processing has been notified and authorized by the CNDP under receipt/authorization No. ...... dated ...... .

The personal data collected by the Publisher may be transmitted to N+ONE, located at 2, Hmida Lakrari Street -ex Celli – 20000 (Hosting Provider) and SEOCOM SARL, located at Floor 1 Imm C Apt 3 Residence Al Abraj Bokar Marrakech 40030 Marrakech, Morocco (Infrastructure Management Provider) for the purposes of data storage and hosting.

You can exercise any right described in this section with the data controller designated as competent by this personal data protection charter, by sending an email to [email protected]. Please note that we may ask you to verify your identity before taking further action regarding your request.

1. Managing Your Information

You can update certain information (email, password) when using the Pass Jeunes application in a profile section. You are responsible for keeping your personal information up to date.

2. Correction of Inaccurate or Incomplete Information

You have the right to ask us to correct inaccurate or incomplete personal information about you (which you cannot update yourself on the application).

3. Access to Data and Portability

Applicable law may allow you to request copies of your personal information that we hold. You may also be allowed to request copies of the personal information you provided to us in a structured, commonly used, and machine-readable format and/or ask us to transmit this information to another service provider (where technically feasible).

4. Retention and Deletion of Data

In general, we retain your personal information for as long as necessary for the performance of the agreement between you and us and to comply with our legal obligations. If you no longer wish us to use your information to provide you with the Pass Jeunes services, you can ask us to delete your personal information.

However, please note that because we maintain the Pass Jeunes application to protect it from accidental or malicious loss and destruction, residual copies of your personal information may not be deleted from our backup systems for a limited period of time.

Upon downloading the Application, these T&C are subscribed to for an indefinite period from their acceptance by the User under the described conditions.

Suspension - Termination of the Account

1. At the Initiative of the User

The User can request the deletion of their account at any time via the Application or by sending a request to the Email [email protected]. The deletion of an account results in the loss of the Credit for the User.

The User can cancel the deletion of their Account if the cancellation process was initiated less than 30 days ago. Once the 30-day period has passed, the account will be permanently deleted.

2. At the Initiative of the Ministry

- When the User reaches the age of 31, their Pass Jeunes expires automatically, resulting in the cancellation of unused credit.

- The ministry may terminate the use of the Application at any time by granting a 30-day termination notice to Users.

- At the time of any termination, the rights granted to Users will be terminated.

- In the event of a breach that is reparable by the User of their obligations, such as providing outdated or incomplete information during registration or subsequently, the ministry will inform the User, requesting necessary corrective measures to be taken promptly. In the absence of a response or correction from the User, the ministry may suspend the User's account pending compliance.

- In case of suspected fraud on the User's account, the ministry will immediately block the account. The User agrees to provide all necessary information for the recovery of their account.

- Any serious and/or irreparable breach by the User of their obligations, such as identity theft, proven credit fraud, or any other fraudulent activity, will result in the deletion of the User's account.

- Any deletion of the User's account for failure to fulfill their obligations will result in the loss of the Credit balance, as well as the obligation for the User to reimburse the Ministry for any amounts improperly collected.

- The User is informed that the Ministry may take legal action against the User, seeking in particular the reimbursement of all costs incurred by the non-conforming use of the Credit, as well as the compensation for the damage suffered.

Links to Other Sites

The Application may contain links to third-party websites or applications. The linked sites are not under the control of the ministry, which is not responsible for their content. The ministry declines all responsibility in the event of any technical problem and/or security breach arising from a hypertext link placed on its Application or Site.

It is up to the User to carry out all necessary or appropriate verifications before proceeding with any transaction with one of these third parties outside the Application.
